By issuing a so-called negative reference 25 companies are forbidden from participating in public tenders in the country, for one to five years.

According the Public Procurement Law, starting from July 1, 2012 state institutions are given the right to ban companies from submitting bids by issuing them a so-called negative reference for the period of 1 up to 5 years. The negative references are published on the Electronic System for Public Procurement (ESPP). A reference should be issued to a company which withdraw its already submitted bid or offer, refuse to sign the contract or whose bank guarantees have been activated. One negative reference bans company’s participation in public procurements for a year. Every next negative reference adds additional year, up to maximum of five years. Out of 25 companies in total that have been black-listed so far, 19 are banned for one year and six for period of two to five years.
